Though Broadway’s “Avenue Q” says, “The Internet is for Porn,” in real life the answer is harder to come by. A trial is scheduled in Pensacola, Florida which will question that statement of collective net wisdom. Clinton Raymond McCowen is the defendant. He’ll be happiest if his adult web site doesn’t get him sent to jail. He hopes the answer is yes, porn is what the Internet’s for.

Deciding what is pornographic or not has always been a tough call. It was Supreme Court justice, Potter Stewart, who said “I know it when I see it.” Love that. In 1973 (Miller v California) we thought the issue was finally decided when the Supreme Court ruled porn would be defined by, “applying contemporary community standards.”

That gave us a new problem. What exactly are community standards and how do you measure them? McCowen’s attorney, Lawrence Walters says community standards are easy to measure today because we’ve got the Internet and we’ve got Google! This is an extension of a strategy he used in another pornography case. There, he compared the number of hits from porn terms like orgy with the number of hits from contemporary concepts, like University of Florida quarterback Tim Tebow. Sorry Tim, you lose. And, so did Walters’ client.

This time around the strategy gets a twist. Attorney Walters will show what Pensacola been searching for using Google Trends. He’s also subpoenaed Google, asking for more detailed results than those available online. Google hasn’t responded yet.

Is this year different? Or just empty bluster? From Catholic News: John D’Arcy, Bishop of Fort Wayne-South Bend, has responded to the decision by the president of Notre Dame to allow the performance of the Vagina Monologues, calling the play “pornographic” and “spiritually damaging.” “As bishop of this historic diocese, entrusted with the spiritual welfare of all those who live within its borders, including the students at our beloved Notre Dame, I believe that, once again, I must publicly and respectfully disagree with Father Jenkins’ decision,” Bishop D’Arcy said, in a written statement posted on the website of the Diocese of Fort Wayne-South Bend.Bishop D'Arcy's statement is here. Father Jenkins has informed me that, while he thinks that this play is a bad play, he believes that permitting its performance under certain conditions, namely, in an academic building without fundraising and with a panel discussion afterwards in which the Catholic perspective is represented, is consistent with the identity of a Catholic university. In particular, Father Jenkins believes that reading the works of authors such as Nietzsche, Gibbon, Luther and Joyce, who in various ways espouse ideas that are contrary to Catholic teaching, in classes at Notre Dame, is comparable to permitting performances of “The Vagina Monologues” under the conditions specified. As bishop of this historic diocese, entrusted with the spiritual welfare of all those who live within its borders, including the students at our beloved Notre Dame, I believe that, once again, I must publicly and respectfully disagree with Father Jenkins’ decision. I am convinced that permitting performances of “The Vagina Monologues” is not consistent with the identity of a Catholic university and not comparable to the long accepted academic tradition through which a wide variety of authors are read and discussed in classes at Notre Dame and in all institutions of higher learning. In the first place, the difference between the works of authors such as Nietzsche, Gibbon, Luther and Joyce, and “The Vagina Monologues” is a difference, not of degree, but of kind. The former have written serious philosophical, theological and literary works, which have influenced Western thought. As such, their work has academic merit and is worthy of serious discussion and critique in a classroom setting. Father Jenkins believes that Eve Ensler’s play was written to shock and offend. How can one put such a play, which many consider pornographic, on the level of serious works such as the writings of Gibbon and Luther? Thank you, Bishop, for disagreeing, but is there anything else you feel compelled to do? John Jalsevac relays: In short, people push to have this play performed year after year because they endorse the message it conveys, and they want to be part of the international campaign to promote this message. In allowing performances of the play on campus again this year, whether or not they are officially considered part of the V-Day campaign, Notre Dame continues to cooperate in advancing the campaign's agenda, an agenda which, as I have repeatedly reflected in my several statements over the years, is directly opposed to the dignity of the human person and is antithetical to Catholic teaching. If Notre Dame goes ahead and allows the performance of the play on campus, it will be the sixth year in a row that it has done so.
